EFF and ATM challenge Parliament's Phala Phala decision in ConCourt
The EFF and ATM recently brought a case to the Constitutional Court, challenging Parliament's handling of the Phala Phala controversy involving President Cyril Ramaphosa.
They argue that the National Assembly’s decision in December 2022 to reject the Independent Panel's findings which suggested prima facie evidence of wrongdoing by Ramaphosa was irrational and violated constitutional accountability obligations.
The case revolves around the alleged concealment of foreign currency at Ramaphosa’s Phala Phala farm and claims that the funds were stolen during a 2020 burglary.
The panel's report, led by former Chief Justice Sandile Ngcobo, raised concerns about potential violations of the Constitution and anti-corruption laws.
However, subsequent investigations by the Public Protector, SARS, and SARB cleared Ramaphosa of misconduct, and the NPA opted not to prosecute.
The EFF and ATM are requesting the court to overturn Parliament's rejection of the panel report and establish an impeachment committee.
Judgment on the case has been reserved after intense legal arguments, including debates over the sufficiency of evidence and parliamentary rules that the applicants claim allow the ANC to shield its members.
